Terms & Conditions
1. Scope of Application
1.1 These Terms and Conditions ("Terms") apply to all contracts concluded between Ethereal Home (hereinafter referred to as “Seller”, “we”, “us”) and the customer (hereinafter referred to as “Customer”) via the online shop.
1.2 A consumer within the meaning of these Terms is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity within the meaning of § 13 BGB.
1.3 Deviating or supplementary terms of the Customer shall not become part of the contract unless expressly agreed in writing.
2. Conclusion of Contract
2.1 The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to submit an offer.
2.2 By placing an order, the Customer submits a binding offer to conclude a purchase contract.
2.3 The Seller may accept the offer within five (5) days by:
- sending an order confirmation in text form, or
- dispatching the goods, or
- requesting payment
2.4 The contract shall be concluded at the moment of acceptance by the Seller.
3. Prices and Payment Terms
3.1 All prices stated are in Euros (€) and include statutory value-added tax (VAT), unless otherwise indicated.
3.2 Shipping costs are not included in the purchase price and will be displayed separately during the ordering process.
3.3 Payment shall be made immediately upon conclusion of the contract via the payment methods offered (e.g., credit card, PayPal, etc.).
3.4 The Seller reserves the right to exclude certain payment methods in individual cases.
3.5 In case of default in payment, the Seller shall be entitled to charge statutory default interest pursuant to § 288 BGB.
4. Delivery and Shipping Conditions
4.1 Delivery shall be made to the delivery address specified by the Customer.
4.2 Delivery periods stated are non-binding unless expressly agreed otherwise.
4.3 In the case of pre-order or pre-launch products, delivery may take place within a period of up to four (4) weeks from the date of purchase.
4.4 If delivery fails due to reasons attributable to the Customer, the Customer shall bear the reasonable costs incurred.
4.5 The risk of accidental loss or deterioration shall pass to the Customer upon delivery.
5. Retention of Title
5.1 The goods shall remain the property of the Seller until full payment has been received.
6. Right of Withdrawal (Widerrufsrecht)
6.1 Consumers have a statutory right of withdrawal of fourteen (14) days pursuant to Directive 2011/83/EU.
6.2 The withdrawal period shall be fourteen (14) days from the day on which the Customer or a third party designated by the Customer takes possession of the goods.
6.3 To exercise the right of withdrawal, the Customer must inform the Seller of the decision to withdraw by means of a clear declaration (e.g., email).
6.4 The Customer shall bear the direct costs of returning the goods.

7. Warranty (Gewährleistung)
7.1 The statutory warranty rights shall apply.
7.2 The limitation period for claims for defects is two (2) years from delivery of the goods.
7.3 Minor deviations in color, texture, or finish resulting from natural materials or handcrafted production shall not constitute defects.
8. Liability
8.1 The Seller shall be liable without limitation for damages resulting from injury to life, body, or health.
8.2 The Seller shall also be liable without limitation in cases of intent and gross negligence.
8.3 In cases of slight negligence, the Seller shall only be liable for breach of essential contractual obligations (cardinal obligations), limited to foreseeable damages typical for the contract.
8.4 Liability under the Product Liability Act remains unaffected.
9. Data Protection
9.1 The Seller processes personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).

10. Force Majeure
10.1 The Seller shall not be liable for delays or failure to perform due to events beyond reasonable control, including but not limited to:
- natural disasters
- strikes
- pandemics
- supply chain disruptions
10.2 In such cases, delivery obligations shall be suspended for the duration of the event.
11. Applicable Law
11.1 The law of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
11.2 Mandatory consumer protection provisions of the country in which the Customer has habitual residence remain unaffected.
12. Dispute Resolution
12.1 The European Commission provides a platform for online dispute resolution (ODR):

12.2 The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
13. Final Provisions
13.1 Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
13.2 Amendments and supplements to these Terms must be made in writing.
